There's no easy way to say it -- this is a dark time for our already-hobbling labor movement.

Last month, the Supreme Court heard arguments in the Cedar Point Nursery v. Hassid case -- in which two agricultural corporations are challenging a California regulation that allows labor unions to talk to workers on the property (during very limited, non-work hours). Their goal is total defiance to any state law affirming any union organizing rights on corporate property.

And what are they invoking? You guessed it -- their constitutional rights.Specifically the Takings Clause of the 5th Amendment, which states that private property shall not “be taken for public use, without just compensation.”

It's unclear if they'll win this case taking such an extreme position...this time...though they might. If so, it will have implications far beyond the rights of farmworkers to organize to strengthen and embolden all corporate employers to crush union activity among their exploited workers. Even if not, it lays the groundwork for the next case in the never-ending quest to expand corporate constitutional rights.

It is more important than ever that people understand that overturning Citizens United is NOT ENOUGH -- when the fundamental problem is the doctrine of corporate constitutional rights. Not enough to make an amendment effort worthwhile.

And certainly not enough to stop the corporate rule that is destroying our rights, our commons and the very planet we live on.

Movements grow when we are all connected -- educating, agitating and organizing with one another. And all of our movements -- be it for labor/economic justice, racial/social justice, or environmental justice -- are up against the same behemoth: corporate rule.
